01Who we are

NeoApex Saver Private Limited (formerly Apex Consultants) is a government incentive advisory firm in Ahmedabad, Gujarat. In this policy, “NeoApex Saver”, “we”, “us” and “our” mean NeoApex Saver Private Limited.

We decide why and how your personal data is processed, which makes us the Data Fiduciary under the Digital Personal Data Protection Act, 2023. We handle personal data in line with that Act, the rules made under it and the Information Technology Act, 2000.

02What we collect

Information you give us

When you fill in our enquiry form, call, email or message us on WhatsApp, we collect your name, company, mobile number, email address, the location of your unit and the project details you choose to share — for example what you manufacture, your planned investment, loans, power consumption and timelines.

Information from our work together

If you engage us, we collect what is needed to assess and file your incentive applications, such as registrations, project reports, invoices, loan sanction letters, electricity bills and the contact details of your authorised representatives. Most of this relates to your business; where it identifies individuals, this policy applies.

Information collected automatically

When you visit the website, we and our service providers collect technical data such as your IP address, browser and device type, the pages you visit, how long you stay, the website that referred you and the campaign tags in the link you followed (for example UTM parameters or a Google Ads click identifier). When you send the enquiry form, we record how you found our site — the page you landed on, any campaign tags and the referring website — together with your enquiry.

What we do not need

To respond to an enquiry we do not need sensitive information such as passwords, card or bank account numbers, or health or biometric data. Please do not include it in forms or messages.

03How we use it

• To respond to your enquiry, assess your eligibility and call you back — based on the consent you give when you send the form.
• To provide the services you engage us for, including preparing, filing and following up incentive applications with government departments, agencies and banks — based on your consent and our engagement with you.
• To keep you informed about your application and about changes to the schemes that affect it. You can ask us to stop at any time.
• To understand how the website is used and to measure our advertising, using aggregated analytics.
• To keep the records the law requires, resolve disputes and protect our rights, as the law permits.

We do not sell personal data, and we do not use it for unrelated purposes without asking you first.

04Who we share it with

• Government departments and agencies that decide incentive claims — for example the Industries Commissionerate, District Industries Centres, the Chief Electrical Inspector, electricity distribution companies, GIDC and customs authorities — only as needed to file and pursue your application, and on your instruction.
• Banks and financial institutions, where your application requires it (for example an interest subsidy claim), on your instruction.
• Service providers that help us run our business, such as our website and email host (Hostinger), Google (analytics and advertising measurement) and Meta (WhatsApp). They process data on our behalf or under their own terms.
• Our professional advisers, such as chartered accountants, lawyers and auditors, who are bound by confidentiality.
• Authorities, where the law requires us to disclose it.

Some of these providers store data outside India. Indian law allows this unless the Government restricts transfers to a particular country, and we choose providers that protect data appropriately.

05Cookies, analytics and advertising

We use Google Analytics, provided by Google LLC, to understand how visitors use the website — for example which pages are read and how long visits last. Google Analytics uses cookies such as _ga and reports aggregated information to us.

When we advertise, we may use Google Ads conversion tracking and remarketing. This means third-party vendors, including Google, may show our ads on sites across the internet and may use cookies to serve ads based on your past visits to our website.

Embedded Google Maps and our call button are provided by third parties and may set their own cookies.

Your choices: you can block or delete cookies in your browser settings, opt out of personalised advertising in Google’s Ads Settings, and opt out of Google Analytics with the Google Analytics opt-out browser add-on. Google explains how it uses information from sites that use its services.

06How long we keep it

• Enquiries that do not lead to an engagement: up to 24 months after our last contact, unless you ask us to delete them sooner.
• Client records: for the length of the engagement and afterwards for as long as the incentive schemes you use remain open (claims under some schemes run for several years), and for as long as the law requires us to keep business records.
• Analytics data: kept by Google in aggregated form, under the retention settings of our Google Analytics account.

When we no longer need personal data, we delete or anonymise it.

07How we protect it

We use reasonable security safeguards. The website is served over HTTPS, access to enquiries and client files is limited to the people who need it, and our accounts are protected by passwords and access controls. No method of transmission or storage is completely secure. If a personal data breach affects you, we will tell you and the Data Protection Board of India, as the law requires.

08Your rights

Under the Digital Personal Data Protection Act, 2023 you can:

• ask for a summary of the personal data we hold about you and how we have used and shared it;
• ask us to correct, complete, update or erase your personal data;
• withdraw your consent at any time — this does not affect processing already carried out, but we may then be unable to act for you;
• have your grievances addressed; and
• nominate another person to exercise your rights if you die or become unable to do so.

To make a request, email info@apexc.co.in with the subject “Personal data request”. We may need to verify your identity. We will respond within the time the law allows and in any case within 90 days. If you are not satisfied with our response, you can complain to the Data Protection Board of India.

10Children

Our services are meant for businesses. We do not knowingly collect personal data of anyone under 18. If you believe a child has sent us personal data, contact us and we will delete it.

11Links to other websites

Our website links to other sites, such as government portals, Google Maps and WhatsApp. They have their own privacy practices; please read their policies.

12Changes to this policy

We may update this policy as our services or the law change. The date at the top shows when it last changed; if a change is significant, we will say so on this page.
